Privacy Notice

How we collect and use personal data, and the rights you have over it under the GDPR.

This notice explains how Hemisphere Logistics collects and uses personal data when you visit this website or ask us for a quote, and the rights you have over that data. It is written to meet Articles 13 and 14 of the EU General Data Protection Regulation (GDPR).

Hemisphere Logistics is a subsidiary of Independent Container Line, Ltd. (4222 Cox Road, Glen Allen, VA 23060, USA), which forms part of the same group and may process data on our behalf as described in section 5.

2. What this notice covers

This notice covers personal data collected through this website, including our quote request form, and correspondence that follows from it. It does not cover any third-party website you reach by following a link from here — those sites publish their own notices.

3. What we collect, why, and on what legal basis

We only collect data we actually need. Under the GDPR, every use of personal data needs a lawful basis; ours are set out below.

Quote requests. Company, contact name, email address, telephone number, and the shipment details you provide (coil type, weight per coil, origin, destination, and any further details you write). To respond to your enquiry, prepare a quotation, specify the right Coil-Tainer™ configuration and tradelane, and — if you go ahead — to arrange and perform the transport. Art. 6(1)(b): steps taken at your request before entering a contract, and performance of that contract. Where you enquire on behalf of a company, Art. 6(1)(f): our legitimate interest in responding to business enquiries. Where no contract follows, we keep the enquiry for as long as we may reasonably expect further contact about it, and review such enquiries periodically; where a contract follows, for the term of the contract plus the statutory retention period that applies to the records.
Correspondence. Emails, letters and call records, including anything you choose to tell us. To answer you, keep an accurate record of what was agreed, and handle any complaint or claim. Art. 6(1)(b) where it relates to a contract; otherwise Art. 6(1)(f): our legitimate interest in managing customer relationships and keeping business records. For the duration of our relationship with you, and afterwards for as long as the applicable Belgian commercial and tax record-keeping rules require us to retain the underlying records
Server logs. Your IP address, the date and time of your request, the pages requested, referring page, and your browser and operating system. To operate the site securely and reliably, detect and investigate abuse or attacks, and diagnose faults. Art. 6(1)(f): our legitimate interest in the security and stability of our website. For a short period only — as long as needed for security monitoring and fault diagnosis, after which our hosting provider rotates and deletes them
Cookies. See section 4. To keep the site working and to remember your cookie choice. Strictly necessary cookies: Art. 6(1)(f) and the exemption in the ePrivacy rules. Any non-essential cookie: Art. 6(1)(a), your consent. See the table in section 4.

Do you have to give us this data? No — you are not required by law to provide it. But we cannot prepare a quotation or arrange a shipment without the contact and shipment details in the form, so if you leave them out we will not be able to help you.

4. Cookies

A cookie is a small file placed on your device by a website. We use as few as possible.

Withdrawing consent. You can change or withdraw your cookie choice at any time using the cookie banner or its withdraw option, and you can delete cookies in your browser settings at any time. Withdrawing consent does not affect the lawfulness of anything done before you withdrew it.

We do not use analytics, advertising or social-media tracking cookies on this site. If we introduce any in future, we will list it here with its provider, purpose and duration, and it will load only after you consent.

5. Who we share your data with

We do not sell your personal data, and we do not share it for anyone else's marketing. We share it only with:

  • Our group. Independent Container Line, Ltd. (USA), our parent company, where this is needed to quote for or perform your shipment — for example on US-connected tradelanes.
  • Service providers acting on our instructions (processors), each bound by a written contract under GDPR Art. 28: our website hosting provider and our email provider. We can tell you who they are on request.
  • Carriers, agents and customs authorities where this is necessary to actually move and clear your cargo.
  • Professional advisers (accountants, auditors, lawyers, insurers) where they need it to advise us.
  • Public authorities where we are legally required to disclose it.

6. Transfers outside the European Economic Area

Because our parent company and part of our operation are in the United States, your data may be transferred outside the EEA. Where that happens we rely on one of the safeguards GDPR permits — an adequacy decision by the European Commission (including the EU–US Data Privacy Framework where the recipient is certified), or the European Commission's Standard Contractual Clauses together with any additional measures needed.

7. How we protect your data

We use appropriate technical and organisational measures to protect personal data, including encryption of traffic to this site (HTTPS), access controls limiting who can see enquiry data, and keeping our software patched. No system is perfectly secure, but we take these obligations seriously and will notify you and the supervisory authority of a personal data breach where the GDPR requires it.

8. Your rights

Under the GDPR you have the right to:

  • Be informed — which is what this notice is for.
  • Access your personal data and receive a copy of it.
  • Rectification — have inaccurate data corrected and incomplete data completed.
  • Erasure — have your data deleted where one of the grounds in Art. 17 applies.
  • Restrict processing in the circumstances set out in Art. 18.
  • Data portability — receive data you gave us in a structured, commonly used, machine-readable format, and have it sent to another controller where technically feasible.
  • Object to processing based on our legitimate interests, on grounds relating to your situation. You may object to direct marketing at any time, and we will stop.
  • Withdraw consent at any time, where we rely on consent.
  • Not be subject to automated decision-making that produces legal or similarly significant effects. We do not carry out automated decision-making or profiling on this website.

How to exercise your rights. Email coiltainer@hemisphere.be or write to us at the address in section 1. We will respond within one month, and will tell you if we need longer because the request is complex. Exercising these rights is free; we may charge a reasonable fee or refuse only where a request is manifestly unfounded or excessive. We may ask you for information to confirm your identity before we act.

9. Your right to complain

If you believe we have handled your data improperly, please tell us first so we can put it right. You also have the right to lodge a complaint with a supervisory authority — in Belgium, where we are established:

You may also complain to the supervisory authority in the EU country where you live or work.

10. Children

This is a business-to-business website and is not directed at children. We do not knowingly collect personal data from children. If you believe a child has given us personal data, contact us and we will delete it.

11. Changes to this notice

If we change how we handle personal data, we will update this notice, change the version number and date at the top, and — where the change is significant — tell you directly.
